TERMS OF SERVICE
1 DEFINITION
1.1 The Pharmacie de Petange – is the author and owner of the offer of the website www.pharmacieonline.lu, registered in the Luxembourg Trade Register under number A41263 with its registered office at Avenue de la Gare, 4734 Petange
1.2 A customer is a natural person of legal age who has the legal capacity required to place and fulfill an order, to place an order with Pharmacie de Petange.
1.3 These general terms and conditions apply to all sales and transactions carried out by Pharmacie de Petange. Every order confirmed by the customer represents an irrevocable acceptance of these general terms and conditions by the customer, like a handwritten signature and cannot be questioned. A deviation from these General Conditions of Sale is only permitted if this has been expressly agreed in writing. The provisions that have not been deviated from, remain fully applicable.
1.4 The general terms and conditions can be changed at any time. The general terms and conditions that apply to an order apply at the time that order is confirmed on the website.
2 PRICE
2.1 All prices are given in euros and must be paid for. The Luxembourg VAT is included. Shipping costs are shown separately, also in euros. When shipping to outside of the European Union, import costs, duties and taxes may be incurred, which are borne by the buyer.
2.2 The Pharmacie de Petange reserves the right to change prices at any time. However, the products will be invoiced based on availability at the time the order is placed.
2.3 The products remain the property of the Pharmacie de Petange until the price has been paid in full.
2.4 The products and services sold on the Pharmacie de Petange website are reserved for individuals.
3 ORDERS
3.1 The automatic registration serves as proof of the type, content and date of the order. The Pharmacie de Petange confirms the acceptance of the order to the customer at the email address given by him. The sale is only finalized with the confirmation of the order.
3.2 The information provided by the buyer when accepting the order is mandatory. In the event of an error in the data and / or contact and delivery details provided by the customer, the Pharmacie de Petange is not liable.
3.3 The Pharmacie de Petange reserves the right to cancel or refuse orders if a dispute consists of a previous order.
3.4 You declare that you have read and accepted these terms and conditions before placing your order. The validation of your order therefore requires the acceptance of these general terms and conditions.
4 AVAILABILITY
Our product offers and prices apply while stocks last. In this context, information on the availability of products is provided at the time of your order. Errors or changes can occur in exceptional cases. In the event that a product is unavailable after you have placed your order, we will inform you by email.
5 DELIVERY
5.1 The products will be delivered to the delivery address that you specified during the ordering process. The shipping costs are calculated as a flat rate and apply according to the applicable rates.
5.2 After the order has been confirmed, the Pharmacie de Petange undertakes to deliver all the products ordered as quickly as possible. After receipt of payment, every item available in our stock is usually dispatched on the same working day / at the latest on the next working day.
5.3 Deliveries are made by post and parcel service (DPD / Chronopost). The goods are dispatched at the risk of the recipient. All events of any kind that are beyond the control of the Pharmacie de Petange (e.g. force majeure, strikes, accidents, etc.) which lead to delays are not the responsibility of the Pharmacie de Petange. Pharmacie de Petange can, at its own discretion, suspend, terminate or cancel deliveries without any compensation to the customer. All products can also be picked up from the pharmacy after ordering online (click & collect).
5.4 If the postal and parcel service (DPD / Chronopost) cannot deliver the shipment to the delivery address and the goods are returned – the same costs apply as for the original shipment (costs also apply to free shipping – since these are paid by us one-to-one) – plus a processing fee of 15 EUR. This amount will be deducted from any possible refund. (e.g. Luxembourg EUR 9,41 shipping plus EUR 9,41 return plus EUR 15 processing fee = EUR 33.82 will be deducted)
6 PAYMENT
6.1 The price invoiced to the customer in accordance with the order confirmation sent must be paid on the day of the actual order.
6.2 The customer has several options for payment, e.g. B. Credit Card, Digicash, Paypal. The order is only considered accepted when the payment center in question has authorized the payment. In the event of rejection, the order is canceled and the customer is notified by email. In any case, the online transmission of the payment data and the final validation of the order in accordance with the Electronic Signature Act are proof of the completeness of the order and the authorization to execute the amounts due.
7 SECURITY
Our website is subject to a security system. Your payment details are encrypted with SSL (Secure Socket Layer). Payment is made to the bank of the Pharmacie de Petange. Pharmacie de Petange does not have access to these details and does not save them on its servers. For this reason, you will be asked again for each new transaction on our website.
8 RETURN TERMS AND REVOCATION POLICY
8.1 You have the right to withdraw from this contract within 14 calendar days without giving any reason. This period begins on the day on which the customer or a third party named by the customer takes possession of the goods.
8.2 A return can only be accepted if the customer sends back or returns the goods in their original packaging with all accessories to Pharmacie de Pe tange, 10 Avenue de la Gare, 4734 Petange within 14 calendar days. Possible costs, risks and dangers for a return are at the expense of the customer.
8.3 For legal and hygienic reasons, returns of the following products cannot be accepted:
– All products with special storage conditions
– Pharmaceutical products and drugs
– Products where the seal is damaged
– Products with signs of use or damage
– Food and nutritional supplements
8.4. When paying by credit card, a refund can be made to the credit card used.
When paying via Digicash, a refund can only be made as a transfer after deducting the Digicash fees (2.5% plus TVA). A refund via Digicash is currently not possible.
In the case of a transfer, the refund will be made to the same account.
9 INTELLECTUAL PROPERTY
All content, texts, illustrations and images published on the www.pharmacieonline.lu websites are subject to copyright and intellectual property of Pharmacie de Petange and its suppliers / partners. As such and in accordance with the provisions of the Law on Intellectual Property, the use may only be for private use, provided that other or even more restrictive provisions of the Law on Intellectual Property apply. Any total or partial reproduction of the www.pharmacieonline.lu / Pharmacie de Petange website is strictly prohibited.
10 LIABILITY
10.1 The products offered comply with the applicable Luxembourg law. The Pharmacie de Petange cannot accept responsibility if the legal provisions and import regulations of the country in which the products are delivered are not complied with.
10.2 The photos are for illustrative purposes only. Details such as colors and sizes may differ from the actual products as each type of screen has different display properties. In the event of an obvious mistake between the properties of the product and its presentation, the Pharmacie de Petange cannot be held responsible.
11 APPLICABLE LAW
11.1 This contract and all business with www.pharmacieonline.lu / Pharmacie de Petange are exclusively subject to Luxembourg law.
11.2 The contract language is French. In the event of a dispute, the Luxembourg courts have exclusive jurisdiction.
